Terms of service
These are the terms on which UK pubs, restaurants and hospitality groups use Pip Social. They cover what the service does, what you are responsible for, what everything costs, and how either of us can bring the agreement to an end.

1. These terms
These terms are the agreement between FortitudeOS Ltd and the business that subscribes to Pip Social. Where these terms say we, us or Pip Social, they mean that company. Where they say you, they mean the business named on the account, and everyone you give access to it.
By creating an account, or by using Pip Social, you accept these terms on behalf of your business. If you are not authorised to do that, do not use the service.
Pip Social is a product sold to businesses. It is not sold to consumers, and the consumer cancellation rights that apply to consumer contracts do not apply here.
2. What Pip Social does
Pip Social is a marketing assistant for hospitality venues. It plans a month of marketing, drafts posts, images, video and messages, schedules them to your connected channels, sends email and SMS to contacts you provide, can promote posts as paid advertising on your behalf, and reports on what happened.
We improve the service continuously. Features change, and some are added or withdrawn. We will not make a change that removes a material part of what you pay for without telling you first.
3. Your account and your team
You are responsible for everything done under your account, including by the team members you invite. Keep credentials private, and remove people who leave.
You must give accurate account, venue and billing information and keep it current. Your venue address is used to work out where your audience is, so an inaccurate one degrades the product.
Accounts are for the venues named on them. Do not resell Pip Social or use one subscription to run marketing for a business that is not on the account.
4. Acceptable use
You must not use Pip Social to do any of the following.
- Send marketing to anyone who has not given you the consent that UK law requires, or who has asked you to stop.
- Upload a contact list you do not have the right to use, including a bought or scraped list.
- Publish content that is unlawful, defamatory, discriminatory, obscene, or that infringes anyone else's rights.
- Impersonate another business or person, or misrepresent an offer, a price or an event.
- Break the rules of a connected platform such as Meta, Instagram, Google or TikTok.
- Attempt to break, overload, reverse engineer or gain unauthorised access to the service.
We may remove content or suspend an account that breaches this section. Where it is safe and lawful to do so, we will tell you why first.
5. Your content stays yours
You own the venue information, images, video, copy, offers and contact data you put into Pip Social, and you own the content Pip produces for you from it.
You give us the licence we need to run the service: to store your content, process it, show it back to you and your team, and publish it to the channels you connect, for as long as your account is open.
We do not sell your data. We do not market to your customers on our own behalf. We do not use one venue's customer list for another venue.
6. Your customers' data
For your own business data we are the data controller. For the customer contacts you upload or collect through Pip Social you remain the controller and we act as your processor, on your instructions. Our privacy policy sets this out in full, and we will sign a data processing agreement with you on request.
Because you are the controller of that list, you are responsible for having a lawful basis to hold it and the consent that the Privacy and Electronic Communications Regulations require before marketing email or SMS is sent to it. Pip Social gives you the tools, including unsubscribe handling and send-time controls. It does not give you the consent.
7. Content that Pip drafts
Pip drafts marketing content using AI models. Drafts can be wrong. A price, an opening time, an allergen claim, a licensing statement or a factual boast about your venue can all be produced confidently and still be incorrect.
Nothing is published to a live channel without a person on your side approving it. That approval is the point at which the content becomes yours, and you are responsible for what goes out under your venue name.
Check anything that makes a factual, legal or nutritional claim before you approve it. We are not liable for content you approved.
8. Connected platforms and paid promotion
Pip Social connects to third party platforms such as Meta, Instagram, Google Business Profile, TikTok, X and payment and messaging providers. Your use of each of those remains subject to that provider's own terms, and their decisions about your account are theirs, not ours.
Those platforms change their interfaces and their rules without asking us. If a change breaks or removes a feature, we will adapt as quickly as we reasonably can, but we cannot promise a connected feature will always be available.
When you run a paid promotion, the advertising spend is paid by you to the advertising platform under its terms. Our 10% fee is for planning, building and running the promotion and is taken when the promotion starts. We do not guarantee any level of reach, engagement, bookings or sales.
9. What it costs
The subscription covers the product. Anything that costs us money to send or generate is charged for use, and the cost of a send is shown to you before you confirm it.

Each site includes 1,000 Pip tokens a month for AI music and video. Tokens are used before any charge is made, and unused tokens do not roll over.
10. Billing
Subscription fees are charged monthly in advance. Usage charges, such as email, SMS, paid promotion fees and AI generation beyond your included tokens, are charged in arrears for the month in which they were incurred.
All prices exclude VAT, which is added at the prevailing rate. Payment is taken by card through our payment provider using the details you register.
If a payment fails we will retry and tell you. If it remains unpaid we may suspend the account until it is settled. We will not delete your content while we are still talking to you about a failed payment.
We may change our prices. We will give you at least 30 days notice before a change takes effect, and you may cancel before it does.
11. Cancelling
The subscription runs month to month. You may cancel at any time from your account or by emailing us, and the cancellation takes effect at the end of the month you have already paid for. There is no notice period beyond that and no cancellation fee.
We do not refund part months. Usage already incurred, including promotion fees on live campaigns, is still payable.
After cancellation you can export your content and contacts for 30 days. After that we delete or anonymise your data in line with our privacy policy, other than anything we must keep for legal or accounting reasons.
12. Availability and support
We work to keep Pip Social available and we monitor it, but we do not offer a contractual uptime guarantee on the standard subscription. Planned maintenance is scheduled to avoid the times venues most need the product.
Support is by email at humans@go-pip.com. We answer during UK working hours and we aim to reply the same working day.
13. Suspension and termination by us
We may suspend or end your access if you materially breach these terms, if your account is used unlawfully, if a payment is long overdue, or if a connected platform requires it.
Where the reason is something you can put right, we will tell you what it is and give you a fair chance to fix it before we end the agreement.
14. Our intellectual property
Pip Social, its software, its models, its designs, its name and its branding belong to us. Your subscription gives you the right to use the service, not any ownership of it.
If you send us feedback or ideas, we may use them to improve the product without owing you anything for them.
15. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, neither side is liable to the other for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss.
Subject to that, our total liability to you in any twelve month period is limited to the subscription and usage fees you paid us in the twelve months before the claim arose.
The service is provided as it is. We do not warrant that it will be uninterrupted or error free, that AI drafts will be accurate, or that your marketing will achieve any particular result.
16. Confidentiality
Each side will keep the other side's non public information confidential and use it only to perform this agreement. This does not apply to information that is already public, that is received lawfully from someone else, or that must be disclosed by law.
17. Changes to these terms
We may update these terms as the product and the law change. If a change materially affects your rights we will tell you by email or in the app at least 30 days before it takes effect, and you may cancel before it does. The date at the top of this page shows when it was last changed.
18. General
These terms, together with our privacy policy and any data processing agreement we sign with you, are the whole agreement between us about Pip Social.
If any part of these terms is found to be unenforceable, the rest continues to apply. A delay in enforcing a right is not a waiver of it.
You may not transfer this agreement without our consent. We may transfer it to a company that acquires our business, and we will tell you if we do.
There are no third party beneficiaries. Nobody other than you and us can enforce these terms.
19. Governing law
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
